1. Acceptance
By requesting a quote, submitting a form, tendering a shipment, or using axlelane.com, you agree to these Terms. If you do not agree, do not use our services.
2. Our Role as Broker
Axle Lane LLC is a federally authorized property transportation broker registered with the FMCSA under MC 59813034 and USDOT 6478370. We arrange transportation for vehicles through independent, licensed motor carriers.
Axle Lane is a broker, not a motor carrier. We do not own or operate trucks. We do not take possession, custody, or control of your vehicle at any point. All physical transportation is performed by an independent motor carrier with its own operating authority and insurance.
3. Carrier Selection
We make commercially reasonable efforts to select carriers that hold active FMCSA operating authority and appropriate insurance. Before dispatch, we verify the carrier’s authority status and confirm the carrier has represented that its insurance is in force.
We do not guarantee the performance, timeliness, or condition of any motor carrier’s equipment. The motor carrier is an independent contractor solely responsible for the transportation, handling, loading, unloading, and delivery of the shipment.
4. Quotes and Rates
Quotes are estimates based on the shipment details you provide and current market conditions at the time of the quote. Quotes may change if any shipment detail differs from what was represented or if market conditions change before a carrier is assigned.
Once a motor carrier is assigned and we confirm the dispatch details in writing, the price stated in the written confirmation is the confirmed rate, subject to any additional charges disclosed in Section
5. Additional Charges
Additional charges may apply if:
- The vehicle’s actual condition, dimensions, weight, or clearance differs from what was represented.
- Pickup or delivery requires specialized equipment (winch, forklift, rollback, enclosed trailer).
- Access at pickup or delivery is restricted or non-standard.
- The shipment is rescheduled, cancelled, or refused after a carrier is assigned.
- Storage, redelivery, layover, or detention charges are incurred through no fault of the carrier.
We will communicate any additional charges to you as soon as they are identified.
6. Payment
Payment is due as stated in the written confirmation. Any deposit is applied to the total transportation charge. Late payment may accrue interest at 1.5% per month or the maximum rate permitted by law, whichever is less. We may withhold or delay dispatch if payment is not received when due.
Our official payment channels are published on axlelane.com and confirmed from an axlelane.com email address. Any payment request routed through a different domain, personal
email, or outside our published channels should be treated as fraudulent. Call (602) 823-9755 to verify any suspicious request before sending payment.
7. Cancellation
You may cancel at no charge before a motor carrier is assigned. Cancellation after a carrier has accepted the load but before pickup may result in a cancellation fee disclosed in the written confirmation. A shipment in transit cannot be cancelled; any destination change after pickup is treated as a re-route and may incur additional charges.
8. Bill of Lading and Claims
The motor carrier’s Bill of Lading is the transportation contract for the physical shipment. At pickup, inspect the vehicle with the driver, note its condition on the Bill of Lading, and sign it. At delivery, inspect the vehicle before signing. Any damage or discrepancy must be noted on the Bill of Lading at the time of delivery. Signing without noting damage may waive your ability to file a claim.
Cargo claims are filed against the motor carrier under the Carmack Amendment (49 U.S.C. § 14706) and the carrier’s Bill of Lading and cargo insurance. Axle Lane is not liable for cargo loss, damage, or delay caused by the motor carrier. We will help identify the responsible carrier, provide the carrier’s contact and insurance information, and coordinate the claims process.
Personal items placed inside a vehicle during transport are generally not covered by the carrier’s cargo insurance and may be prohibited by the carrier. Personal items are transported
at your risk. Do not place weapons, firearms, illegal substances, hazardous materials, perishables, or living things in the vehicle.
9. Pickup and Delivery Timing
Unless a specific guaranteed service is separately quoted and confirmed in writing, all pickup and delivery dates are estimates. Vehicle transportation is subject to weather, route conditions, driver hours-of-service regulations, and other factors outside our control. We are not liable for delays or for consequential costs such as rental cars, storage fees, lost wages, or missed appointments caused by transportation timing.
10. Insurance
The motor carrier is required to maintain cargo and liability insurance meeting or exceeding FMCSA minimums. Coverage limits, deductibles, and exclusions are set by the carrier’s policy. We will provide the carrier’s insurance information on request.
Axle Lane maintains a $75,000 BMC-84 broker financial responsibility instrument on file with the FMCSA, as required for licensed property brokers.
You are responsible for any personal insurance you may want on the vehicle during transport.
11. Limitation of Liability
To the fullest extent permitted by law, Axle Lane’s total liability under these Terms is limited to the amount of the brokerage fee (not the total transportation charge) collected for the specific shipment giving rise to the claim.
Axle Lane is not liable for indirect, consequential, incidental, special, exemplary, or punitive damages, including lost profits, rental car costs, storage fees, or diminution in value. We make no warranties, express or implied, regarding the motor carrier’s services. We are not liable for the acts, omissions, or negligence of any motor carrier or third party.
Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud, gross negligence, or willful misconduct.
12. Indemnification
You agree to indemnify and hold harmless Axle Lane and its officers, employees, and agents from any claim, loss, damage, penalty, or expense (including reasonable attorney fees) arising from: inaccurate information you provided about the shipment, prohibited items placed in the vehicle, your breach of these Terms, or your violation of applicable law.
13. Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles. Federal transportation law applies where controlling.
Before filing any legal action, you agree to contact us at contact@axlelane.com or (602) 823-9755 and make a good-faith effort to resolve the dispute directly for at least 30 days.
Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Maricopa
County, Arizona, on an individual (non-class) basis. Either party may seek relief in small-claims court as an alternative for qualifying disputes.
14. Website Use
The axlelane.com website is provided as is, without warranties of any kind. We do not guarantee uninterrupted or error-free service. You agree not to interfere with the site’s operation, scrape data without permission, upload malicious code, or misrepresent your identity.
15. Communications
By providing your email or phone number, you consent to receive communications from Axle Lane relating to your quote, shipment, or account. SMS text messages require separate opt-in described in our SMS Terms. See our Privacy Policy for how we handle your contact information.
16. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. You may not assign your rights or obligations without our prior written consent. These Terms, together with our Privacy Policy, SMS Terms, and any written dispatch confirmation, constitute the entire agreement between you and Axle Lane.
